Dabei w\u00e4gt man ab, inwiefern eine Datenverarbeitung ein hohes Risiko f\u00fcr die Freiheiten und Rechte nat\u00fcrlicher Personen nach sich zieht, sodass der <a href=\"https:\/\/www.sage.com\/de-de\/blog\/lexikon\/datenschutz\/\" target=\"_blank\" rel=\"noopener\">Datenschutz<\/a> beeintr\u00e4chtigt werden k\u00f6nnte.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Gem\u00e4\u00df Artikel 35, Absatz 3 der DSGVO ist eine Datenschutz-Folgenabsch\u00e4tzung erforderlich, sobald:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pers\u00f6nliche Aspekte nat\u00fcrlicher Personen automatisiert verarbeitet sowie umfassend und systematisch bewertet werden, damit Entscheidungen getroffen werden k\u00f6nnen, die gegen\u00fcber diesen Personen eine rechtliche Wirkung entfalten bzw. diese in \u00e4hnlich gravierender Weise beeintr\u00e4chtigen;<\/li>\n\n\n\n<li>von personenbezogenen Daten besondere Kategorien (beispielsweise ethnische Herkunft, politische Meinungen, weltanschauliche oder religi\u00f6se \u00dcberzeugungen sowie genetische oder biometrische Daten) oder personenbezogene Daten \u00fcber strafrechtliche Straftaten und Verurteilungen verarbeitet werden (darf nur unter beh\u00f6rdlicher Aufsicht passieren oder wenn es nach Unionsrecht bzw. nach dem Recht der Mitgliedsstaaten zul\u00e4ssig ist);<\/li>\n\n\n\n<li>eine \u00f6ffentliche \u00dcberwachung stattfindet, also \u00f6ffentlich zug\u00e4ngliche Bereiche systematisch und umfangreich \u00fcberwacht werden.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-welche-richtlinien-mussen-unternehmen-beachten-um-dpia-datenschutz-korrekt-umzusetzen\">Welche Richtlinien m\u00fcssen Unternehmen beachten, um DPIA Datenschutz korrekt umzusetzen?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Eine korrekte Datenschutz-Folgenabsch\u00e4tzung in Unternehmen muss mindestens die hier aufgef\u00fchrten Kriterien enthalten:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Eine exakte Beschreibung sowohl der geplanten Verarbeitungsvorg\u00e4nge, der Verarbeitungszwecke, der automatisierten Verarbeitung als auch der berechtigten Interessen des Verantwortlichen.<\/li>\n\n\n\n<li>Die Dokumentation von Notwendigkeit und Verh\u00e4ltnism\u00e4\u00dfigkeit der jeweiligen Erhebung personenbezogener Daten.<\/li>\n\n\n\n<li>Eine Evaluierung der Risiken, die f\u00fcr die Freiheiten und Rechte der Betroffenen entstanden sind.<\/li>\n\n\n\n<li>Die geplanten Abhilfema\u00dfnahmen zur Bew\u00e4ltigung und Minderung dieser Risiken, wie beispielsweise Sicherheitsvorkehrungen und Garantien.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Und noch ein Tipp:<\/strong> Die DSFA gilt auch f\u00fcr personenbezogene Daten in Papierform!<\/p>\n\n\n\n<div class=\"addtoany_share_save_container addtoany_content addtoany_content_bottom\">\n<div
