(days in lieu)<\/a><\/li><li><a href=\"#h-faqs\" data-level=\"2\">FAQs<\/a><\/li><li><a href=\"#h-final-thoughts\" data-level=\"2\">Final thoughts<\/a><\/li><\/ul><\/div>\n\n\n\n<h2 id=\"h-holiday-entitlement-calculator\" class=\"wp-block-heading\"><a><\/a>Holiday Entitlement Calculator<\/h2>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-embed-handler wp-block-embed-embed-handler wp-block-sage-embed\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Holiday entitlement calculator\" src=\"https:\/\/assets.sage.com\/calculators\/holiday\/dist\/en-GB\/index.html\" width=\"100%\" height=\"100vh\" class=\"sage-embed-resize\" style=\"border:none;min-height:500px;\"><\/iframe>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The calculator has two parts:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Holiday entitlement calculator<\/strong> to calculate the statutory leave entitlement for an employee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Holiday pay calculator<\/strong> will calculate how much payment in lieu of notice is to be paid if an employee is leaving.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Information you will need to complete the calculators includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Number of days of holiday entitlement, excluding public holidays.<\/li>\n\n\n\n<li>Days in the work week<\/li>\n\n\n\n<li>Days per week worked by this employee<\/li>\n\n\n\n<li>If your employee is part time, the number of hours worked per day<\/li>\n\n\n\n<li>Number of days per working week (this is usually five working days per week for full-time roles)<\/li>\n\n\n\n<li>The holiday year start and end dates, which are usually 1 January to 31 December<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Note: <\/strong>The calculator doesn\u2019t include a provision for overtime and is to be used as a guide only.<\/p>\n\n\n\n<h2 id=\"h-what-is-the-statutory-holiday-entitlement-in-the-uk\" class=\"wp-block-heading\"><a><\/a>What is the statutory holiday entitlement in the UK?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In the UK, <a href=\"https:\/\/www.gov.uk\/holiday-entitlement-rights\" target=\"_blank\" rel=\"noreferrer noopener\">employees<\/a> are entitled to 5.6 weeks\u2019 paid annual leave, which may include public and bank holidays depending on the employment contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Known as statutory leave entitlement, it means workers are financially protected when they take annual leave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For full-time workers who work a 5-day week, this is a minimum of 28 days per year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a note, holiday entitlement is limited to 28 days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, staff working a 6-day week are still only entitled to 28 days per year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This protection sits within the <a href=\"https:\/\/www.legislation.gov.uk\/uksi\/1998\/1833\/contents\" target=\"_blank\" rel=\"noreferrer noopener\">Working Time Regulations 1998 (WTR)<\/a>, introduced in 1998. The entitlement was originally set at four weeks (20 days for a five\u2011day week), increasing in 2007 and again in 2009.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This increased to 24 days in <a href=\"https:\/\/www.rmt.org.uk\/about\/policies\/research\/employment-law\/changes-to-statutory-annual-leave-entitlement\/?preview=true#:~:text=This%20is%20now%20set%20to,week)%20from%201%20April%202009.\" target=\"_blank\" rel=\"noreferrer noopener\">2007<\/a> and to 28 days in 2009.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although there is a minimum requirement, employers can choose to offer a package that includes more holiday entitlement, but they cannot offer less than the minimum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Large companies will often use a generous holiday policy as part of a package to tempt top talent. This means that their statutory leave entitlement is proportionate to the hours they work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To calculate this, you&#8217;ll need to know:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Number of hours worked in the pay period<\/li>\n\n\n\n<li>Number of full-time hours.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The formula is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Number of hours worked per week \/ full-time hours per week&nbsp;x contracted days entitlement x full-time hours per day = hours of holiday entitlement<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Example, for an employee working 25 hours per week:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">25 \/ 37.5 x 28 x 7.5 = 140 hours of holiday entitlement<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Note, a typical full-time employee works 37.5 hours per week, 7.5 hours per day, 5 days per week.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><a><\/a>How to calculate holiday pay for irregular working patterns or those working for part of the year<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For seasonal workers, temporary workers, or those who work irregular hours, calculating their holiday entitlement used to be complicated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Working Time Regulations 1998<\/strong> were amended by reforms effective <a href=\"https:\/\/www.gov.uk\/government\/publications\/simplifying-holiday-entitlement-and-holiday-pay-calculations\/holiday-pay-and-entitlement-reforms-from-1-january-2024\" target=\"_blank\" rel=\"noreferrer noopener\">January 2024<\/a>, introducing new rules on holiday entitlement and pay for irregular\u2011hours and part\u2011year workers<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These workers now accrue statutory holiday entitlement using an accrual method<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For an employee who works only part of the year, or works irregular hours, their holiday entitlement is calculated at 12.07% of the hours they worked in the pay period. 12.07% is based on the statutory minimum holiday entitlement of 5.6 weeks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if they worked 25 hours and are paid weekly:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>25 \u00d7 12.07 \u00f7 100 = 3.02 or 3 days<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if a zero-hours employee works for 25 hours in June, they will receive 25 x 12.07%= 3.02 hours, rounded to 3 hours of holiday leave entitlement. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This will accrue until they want to take a holiday, or if they leave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From 1 January 2024, rolled-up holiday pay is permitted again for irregular hours and part-year workers, provided it is clearly stated in their contract and shown separately on their pay slip.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p><strong>If you consider making changes to how holiday pay is to be calculated, you should communicate any changes to staff before changes are implemented to allow them to lodge a complaint or rejection if they don\u2019t agree with the proposal.<\/strong><\/p><\/blockquote><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-how-to-calculate-holiday-entitlement-in-the-first-year-of-employment\" class=\"wp-block-heading\"><a><\/a><a><\/a><a><\/a>How to calculate holiday entitlement in the first year of employment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For all \u201cregular\u201d employees, holiday entitlement is accrued over the period the employee works.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because full\u2011time workers (five\u2011day week) are entitled to a <strong>minimum of 28 days<\/strong> of statutory annual leave, which may include public and bank holidays <strong>depending on the contract<\/strong>, you can calculate accrual at the end of each month worked.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For part-time employees, calculate this on a pro-rata basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To calculate, use the following formula:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(Holiday entitlement divided by months in the year) x months worked so far<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An important note is that many employment contracts are for 20 days entitlement, plus public holidays this means that only 20 days accrue and not the public holidays.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Public holidays are dependent on what is outlined in an employment contract as they are not automatically paid, and there is no statutory right to paid public holidays.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, a full-time worker (who works 5 days per week) will accrue five days of holiday after three months: (20 days\/12 months) x 3 months worked = 5 days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since statutory holiday entitlement exists from the first day of employment, there\u2019s no minimum waiting period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For employees who have taken more holiday than they have accrued at that point in the year, this will be made up later in the year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And if an employee leaves, you can claim any overpaid entitlement days back in their final payslip.<\/p>\n\n\n\n<h2 id=\"h-how-to-calculate-holiday-entitlement-when-an-employee-leaves\" class=\"wp-block-heading\">How to calculate holiday entitlement when an employee leaves?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If an employee leaves before they have taken all their paid holiday entitlement, they may be owed payment in lieu of any holiday days they have accrued but not taken.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, an employee\u2019s annual holiday year commences on <strong>1 January<\/strong>, and they are on a salary of \u00a352,000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They work for four months without taking any holiday and then leave at the end of April.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their contracted holiday entitlement is 20 days per year, plus public holidays.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Calculate the holiday days accrued:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Days of contracted holiday entitlement per year divided by 12 months of the year x number of months worked so far<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(20 \/ 12) x 4 = 6.7 days accrued (rounded up to 7 days).<\/p>\n\n\n\n<h2 id=\"h-what-if-an-employee-doesn-t-take-their-statutory-holiday-entitlement-days-in-lieu\" class=\"wp-block-heading\">What if an employee doesn\u2019t take their statutory holiday entitlement? Many contracts include UK bank holidays within the 28\u2011day allowance, while others offer 20 days plus bank\/public holidays. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Check the employment contract to confirm what applies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the company\u2019s discretion, some workers may be entitled to enhanced holiday entitlement, where they are offered, for example, 25 days of holiday plus public holidays, which is a total of 33 days.<\/p>\n\n\n\n<h3 id=\"h-what-is-the-average-uk-holiday-allowance\" class=\"wp-block-heading\"><a><\/a>What is the average UK holiday allowance?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In contrast to the statutory holiday entitlement of 28 days, <a href=\"https:\/\/www.peoplehr.com\/en-gb\/resources\/blog\/uk-annual-leave-report-by-industry\/\" target=\"_blank\" rel=\"noreferrer noopener\">a report <\/a>found that in 2023 the average employee in the UK took 33.9 days of annual leave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;This demonstrates a decline from 36.7 days in 2022, and 38 days in 2020.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s uncertain as to why this decline might be happening.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Possible explanations include people being too busy or not being able to afford to take holidays abroad.<\/p>\n\n\n\n<h3 id=\"h-holiday-allowance-in-the-rest-of-the-world\" class=\"wp-block-heading\"><a><\/a>Holiday allowance in the rest of the world<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">As a comparison, <a href=\"https:\/\/en.wikipedia.org\/wiki\/List_of_minimum_annual_leave_by_country\" target=\"_blank\" rel=\"noreferrer noopener\">in the rest of the world<\/a>, Iran has the most statutory days of holiday at 53 days. Andorra has 45 days and Malta 41.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The UK is a long way down the list for days of holiday entitlement compared to other countries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But at the bottom, Nigeria has only five days and the US does not offer any statutory holiday and holiday entitlement is at the employer\u2019s discretion.<\/p>\n\n\n\n<h3 id=\"h-what-happens-if-an-employee-leaves-part-way-through-a-holiday\" class=\"wp-block-heading\">What happens if an employee leaves part way through a holiday?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An employee only gets holiday pay for days accrued of entitlement and not for all the days of their holiday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As an example, an employee hasn\u2019t taken any other holidays in a year, then decides to leave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Just before they leave, they decide to also take a two-week holiday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, their final day of employment falls on day four of their holiday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that they have only taken four days of their holiday entitlement and not two weeks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their final entitlement should be calculated based on the actual number of days holiday taken whilst employed, which in this case would be four days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Note: as an employer, you are entitled to reclaim days of holiday from an employee if they have taken more days of holiday than they are entitled to.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may do this automatically by deducting the amount from their final salary, but this must be shown in the payslip.<\/p>\n\n\n\n<h3 id=\"h-how-do-illness-maternity-or-paternity-leave-affect-holiday-pay\" class=\"wp-block-heading\"><a><\/a>How do illness, maternity or paternity leave affect holiday pay?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If employees go on long-term sick leave, <a href=\"https:\/\/www.acas.org.uk\/checking-holiday-entitlement\/sickness-and-holiday\" target=\"_blank\" rel=\"noreferrer noopener\">they are eligible<\/a> to carry over <a href=\"https:\/\/www.gov.uk\/holiday-entitlement-rights\/calculate-leave-entitlement#:~:text=If%20a%20worker%20cannot,part%20of%20the%20year\" target=\"_blank\" rel=\"noreferrer noopener\">20 days<\/a> of their statutory entitlement once they return to work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those who have been prevented from taking their holiday due to maternity or paternity leave, are eligible to carry over a full year\u2019s statutory holiday entitlement into the next annual leave year.<\/p>\n\n\n\n<h3 id=\"h-legal-entitlement-to-holiday-pay\" class=\"wp-block-heading\"><a><\/a>Legal entitlement to holiday pay<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Holiday pay should be calculated at the same rate as an employee\u2019s normal compensation, on either a daily or hourly basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, following a <a href=\"https:\/\/www.supremecourt.uk\/cases\/uksc-2019-0209\" target=\"_blank\" rel=\"noreferrer noopener\">ruling in a court case<\/a>, there are a number of situations where payments above basic pay are required to be included in holiday pay:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Workers who have a contract that includes a set commission are entitled to have their commission included in any holiday pay calculation.<\/li>\n\n\n\n<li>Workers who receive extra pay according to their professional status, length of tenure, or qualifications, also receive the extra payment in their holiday pay.<\/li>\n\n\n\n<li>Where employees have regularly worked overtime within the past year, they are entitled to include those hours in their holiday entitlement calculation.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-how-to-calculate-holiday-pay-for-a-monthly-salary\" class=\"wp-block-heading\"><a><\/a>How to calculate holiday pay for a monthly salary<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Monthly salary calculations require you to calculate the daily pay rate of the employee.<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Annual salary divided by 52 = weekly pay<\/strong><\/li>\n\n\n\n<li><strong>Weekly pay divided by number of days in a workweek = daily pay<\/strong><\/li>\n\n\n\n<li><strong>Daily pay times by number of days holiday entitlement = holiday pay<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">A member of staff earns \u00a352,000 per annum and works five days per week.<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>\u00a352,000 \/ 52 = \u00a31,000<\/li>\n\n\n\n<li>\u00a31,000 \/ 5 = \u00a3200<\/li>\n\n\n\n<li>\u00a3200 x 12 = \u00a32,400<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Their daily rate is \u00a3200.
