Les locaux industriels ne sont pas concern\u00e9s.<\/p>\n\n\n\n<p class=\"\"><strong>La decloyer n\u2019a pas d\u2019incidence fiscale<\/strong>. Cette obligation strictement d\u00e9clarative contribue \u00e0 <strong>enrichir le r\u00e9f\u00e9rentiel des valeurs locatives des locaux professionnels<\/strong>. En effet, les donn\u00e9es collect\u00e9es \u00e0 travers la d\u00e9claration des loyers servent \u00e0 \u00e9tablir une valeur tarifaire moyenne par m<sup>2<\/sup> des emprises selon les zones g\u00e9ographiques.<\/p>\n\n\n\n<p class=\"\">La cotisation fonci\u00e8re des entreprises (CFE) est \u00e9tablie depuis 2017 sur la base des informations recueillies via la decloyer. <strong>C\u2019est ainsi que l\u2019\u00e9tablissement de la CFE prend en compte les \u00e9volutions du march\u00e9 locatif<\/strong>. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"\">La d\u00e9claration des loyers des locaux professionnels constitue une <strong>annexe de la d\u00e9claration des r\u00e9sultats<\/strong>. Sa date limite de d\u00e9p\u00f4t est celle du d\u00e9p\u00f4t de la <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/parole-de-dirigeants-les-petits-chaperons-rouges-automatise-sa-gestion-fiscale\/\">liasse fiscale<\/a>, soit la 15<sup>\u00e8me<\/sup> journ\u00e9e du 4<sup>\u00e8me<\/sup> mois suivant la cl\u00f4ture pour les entreprises ayant adopt\u00e9 les t\u00e9l\u00e9proc\u00e9dures. Le d\u00e9p\u00f4t hors d\u00e9lai ou l\u2019absence de d\u00e9p\u00f4t sont passibles d\u2019une <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/dgfip-administration-fiscale-arsenal-juridique\/\"><strong>amende de 150 euros<\/strong><\/a>.<\/p>\n\n\n\n<p class=\"\">La decloyer s\u2019effectue <strong>annuellement<\/strong>, m\u00eame si le montant des loyers est inchang\u00e9 par rapport \u00e0 la d\u00e9claration pr\u00e9c\u00e9dente.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-declaration-des-loyers-nbsp-comment-proceder-nbsp\">D\u00e9claration des loyers&nbsp;: comment proc\u00e9der&nbsp;?<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-etape-1-nbsp-demande-d-information-sur-les-biens-loues\"><strong>\u00c9tape 1&nbsp;: demande d\u2019information sur les biens lou\u00e9s<\/strong><\/h3>\n\n\n\n<p class=\"\">La demande d\u2019information (EDI-REQUETE) consiste \u00e0 <strong>r\u00e9clamer \u00e0 l\u2019administration fiscale les coordonn\u00e9es fonci\u00e8res de chacun des biens lou\u00e9s par votre entreprise<\/strong>. Ce sont ces coordonn\u00e9es qui vont permettre dans la suite de la proc\u00e9dure d\u2019identifier chaque espace concern\u00e9 par l\u2019obligation de d\u00e9claration des loyers.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-etape-2-nbsp-recueil-des-coordonnees-foncieres\"><strong>\u00c9tape 2&nbsp;: recueil des coordonn\u00e9es fonci\u00e8res<\/strong><\/h3>\n\n\n\n<p class=\"\">En retour (mais apr\u00e8s un certain d\u00e9lai, \u00e0 anticiper), la DGFiP vous adresse&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Un <strong>identifiant<\/strong> par entit\u00e9 juridique locataire<\/li>\n\n\n\n<li>Un <strong>num\u00e9ro d\u2019identification<\/strong> et un <strong>descriptif<\/strong> pour chaque emprise lou\u00e9e<\/li>\n<\/ul>\n\n\n\n<p class=\"\"><strong>39 cat\u00e9gories et 5 types de surfaces<\/strong> servent \u00e0 caract\u00e9riser chacun des biens concern\u00e9s. Il vous appartient de v\u00e9rifier et \u00e9ventuellement de rectifier les donn\u00e9es d\u2019identification transmises par l\u2019administration fiscale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-etape-3-nbsp-preparation-et-envoi-du-formulaire-de-declaration-des-loyers\"><strong>\u00c9tape 3&nbsp;: pr\u00e9paration et envoi du formulaire de d\u00e9claration des loyers<\/strong><\/h3>\n\n\n\n<p class=\"\">Il vous reste \u00e0 renseigner, en regard de chacun des biens inventori\u00e9s et identifi\u00e9s, le <strong>montant annuel des loyers, hors charges et hors taxes<\/strong>.<\/p>\n\n\n\n<p class=\"\">Une rubrique explicative vous permet de pr\u00e9ciser d\u2019\u00e9ventuelles <strong>situations particuli\u00e8res<\/strong> (usufruit, cr\u00e9dit-bail, location-g\u00e9rance), qui pourraient justifier des loyers d\u00e9corr\u00e9l\u00e9s.<\/p>\n\n\n\n<p class=\"\">En conclusion, la d\u00e9claration des loyers est une proc\u00e9dure fiscale obligatoire qui ne se traduit pas par une taxe.
