Obligatoire \u00e0 compter de 2023, elle se substitue aux sites des CFE (Centres de Formalit\u00e9s des Entreprises) et vise \u00e0 simplifier la vie des entreprises, de leur cr\u00e9ation \u00e0 leur cessation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Un guichet unique et obligatoire \u00e0 compter de 2023<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Comme le pr\u00e9voient les articles 1 et 2 de la Loi relative \u00e0 <em>la croissance et la transformation des entreprises<\/em>, dite loi Pacte, <strong>un guichet unique regroupe d\u00e9sormais toutes les formalit\u00e9s d&rsquo;entreprise<\/strong> : <a href=\"https:\/\/www.formalites.entreprises.gouv.fr\/\" target=\"_blank\" rel=\"noreferrer noopener\">www.formalites.entreprises.gouv.fr<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">G\u00e9r\u00e9e par l\u2019INPI (Institut national de la propri\u00e9t\u00e9 industrielle), cette plateforme a \u00e9t\u00e9 d\u00e9ploy\u00e9e en 3 \u00e9tapes :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>acc\u00e8s aux professionnels ayant un mandat pour le compte d&rsquo;une entreprise cliente depuis le 1<sup>er<\/sup> juillet 2021 ;<\/li><li>acc\u00e8s \u00e0 tous les cr\u00e9ateurs et entrepreneurs depuis le 1er janvier 2022 ;<\/li><li>usage obligatoire pour toutes les formalit\u00e9s \u00e0 compter du 1er janvier 2023.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c0 partir du 1<sup>er<\/sup> janvier 2023, <strong>le guichet unique sera l&rsquo;unique plateforme permettant aux entreprises de r\u00e9aliser leurs d\u00e9marches<\/strong> aupr\u00e8s des organismes avec lesquels elles sont en relation (Centre de formalit\u00e9s des entreprises, administration fiscale, INSEE, etc.). La plateforme devra \u00eatre utilis\u00e9e en de nombreuses occasions :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>pour la d\u00e9claration de d\u00e9but d\u2019activit\u00e9 ;<\/li><li>pour d\u00e9clarer une \u00e9volution (d\u00e9m\u00e9nagement du si\u00e8ge social, changement du dirigeant, etc.) ;<\/li><li>pour d\u00e9poser les comptes annuels ;<\/li><li>lors de la d\u00e9claration de <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/glossaire\/liquidation-definition-de-la-liquidation-dentreprise\/\">cessation d&rsquo;activit\u00e9<\/a>.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bon \u00e0 savoir<\/strong> : le guichet unique concerne toutes les entreprises, quelle que soit leur forme juridique (entreprise individuelle, EURL, SA, etc.) ou leur activit\u00e9 (artisanale, commerciale, lib\u00e9rale, etc.).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La simplification des d\u00e9marches d\u2019entreprise<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">L&rsquo;instauration d&rsquo;un guichet unique vise \u00e0 simplifier les d\u00e9marches d&rsquo;entreprise. En plus de remplacer les plateformes d\u00e9ploy\u00e9es par les Centres de formalit\u00e9s des entreprises (CFE URSSAF, Guichet Entreprise, etc.), <strong>le site se substitue \u2013 pour certaines fonctions \u2013 aux diff\u00e9rents r\u00e9seaux CFE<\/strong>, \u00e0 savoir :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>l&rsquo;Urssaf ;<\/li><li>la Chambre de commerce et d&rsquo;industrie (CCI) ;<\/li><li>la Chambre de m\u00e9tiers et de l&rsquo;artisanat (CMA) ;<\/li><li>la Chambre d&rsquo;agriculture ;<\/li><li>les greffes des Tribunaux de commerce ;<\/li><li>et la Direction g\u00e9n\u00e9rale des Finances publiques (DGFiP).<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>70 % des formalit\u00e9s d\u2019entreprise <\/strong>sont encore r\u00e9alis\u00e9es au format papier, ce qui repr\u00e9sente 35 tonnes de papier par an<sup>1<\/sup>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depuis le guichet unique, <strong>l&rsquo;entreprise a acc\u00e8s \u00e0 un unique formulaire dynamique<\/strong>. Il permet de r\u00e9aliser toutes les principales formalit\u00e9s et indique les justificatifs \u00e0 fournir selon la nature de la d\u00e9marche et les particularit\u00e9s du demandeur. Gr\u00e2ce \u00e0 celui-ci, <strong>le gouvernement entend simplifier des proc\u00e9dures<\/strong> qui, jusqu&rsquo;\u00e0 maintenant, \u00e9taient complexes et chronophages. Il faut dire que l&rsquo;entreprise devait auparavant :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>faire le tri entre les 56 formulaires Cerfa disponibles<sup>1<\/sup> ;<\/li><li>identifier l&rsquo;organisme comp\u00e9tent pour traiter son dossier ;<\/li><li>se d\u00e9placer au CFE en cas de d\u00e9p\u00f4t d&rsquo;un dossier papier.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La cr\u00e9ation d\u2019un registre professionnel unique<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En plus de la cr\u00e9ation de ce guichet, la loi Pacte a act\u00e9 <strong>l&rsquo;instauration d&rsquo;un registre unique, au sein duquel les informations de toutes les entreprises seront consign\u00e9es<\/strong>.
