Limitation de l\u2019acc\u00e8s au ch\u00f4mage, exp\u00e9rimentation du CDD multi-remplacements, r\u00e9duction de la dur\u00e9e d\u2019indemnisation et incitation \u00e0 la VAE : d\u00e9couvrez tout ce qui change pour votre entreprise et vos salari\u00e9s \u00e0 compter de l&rsquo;ann\u00e9e prochaine.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Une restriction de l\u2019acc\u00e8s au ch\u00f4mage<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Face \u00e0 un nombre d&#8217;emplois vacants important, notamment dans les secteurs sous tension (restauration, BTP, etc.), le <em>projet de loi portant mesures d\u2019urgence relatives au fonctionnement du march\u00e9 du travail<\/em> <em>en vue du plein emploi<\/em> pr\u00e9voit tout d\u2019abord <strong>la suppression de l&rsquo;acc\u00e8s au ch\u00f4mage en cas d&rsquo;abandon de poste<\/strong> sans motif l\u00e9gitime. Si le salari\u00e9 quitte volontairement son poste et ne r\u00e9pond pas \u00e0 la mise en demeure de l&#8217;employeur de reprendre le travail, <strong>son abandon sera consid\u00e9r\u00e9 comme une simple d\u00e9mission<\/strong>, n\u2019ouvrant pas le droit \u00e0 l\u2019allocation d&rsquo;aide au retour \u00e0 l&#8217;emploi (ARE).<\/p>\n\n\n\n<blockquote class=\"wp-block-quote has-text-align-center is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>373 100<\/strong><\/p><p>C&rsquo;est le nombre d&#8217;emplois vacants au 3<sup>e<\/sup> trimestre 2022, soit 3 % de plus qu&rsquo;au 2<sup>e<\/sup> trimestre<sup>1<\/sup>.<\/p><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Le projet de loi pr\u00e9voit aussi<strong> la suppression de l&rsquo;acc\u00e8s au ch\u00f4mage en cas de refus, par un salari\u00e9 en contrat court, d&rsquo;un CDI<\/strong> (contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e). \u00c0 compter du 1<sup>er<\/sup> f\u00e9vrier 2023, un salari\u00e9 en CDD (contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e) ou en contrat d&rsquo;int\u00e9rim ne b\u00e9n\u00e9ficiera pas d&rsquo;indemnisation ch\u00f4mage s\u2019il refuse par deux fois un CDI sur une p\u00e9riode d&rsquo;un an. \u00c0 condition toutefois que le CDI soit semblable au pr\u00e9c\u00e9dent emploi, soit :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>m\u00eame poste ;<\/li><li>m\u00eame lieu de travail ;<\/li><li>et avec un salaire au moins \u00e9quivalent.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bon \u00e0 savoir<\/strong> : l&#8217;employeur sera tenu d&rsquo;informer P\u00f4le Emploi des refus de CDI. Les agents devront alors v\u00e9rifier la l\u00e9gitimit\u00e9 du refus du salari\u00e9, pouvant conduire \u00e0 des sanctions, dont la perte du droit \u00e0 indemnisation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Une nouvelle exp\u00e9rimentation du CDD multi-remplacements<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Peu suivie en raison de la crise sanitaire, <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/tout-comprendre-du-CDD-multi-remplacements\/\"><strong>l&rsquo;exp\u00e9rimentation du CDD multi-remplacements est relanc\u00e9e pour une p\u00e9riode de 2 ans<\/strong>. <\/a>Ce dispositif permet aux entreprises de remplacer plusieurs salari\u00e9s par un seul contrat court, \u00e0 savoir :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>un CDD (contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e) ;<\/li><li>ou un contrat de mission.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Toutefois, le CDD multi-remplacements ne devrait <strong>\u00eatre ouvert qu\u2019\u00e0 certains secteurs d\u2019activit\u00e9<\/strong>, dont ceux rencontrant une forte tension (sant\u00e9, services \u00e0 la personne, nettoyage, etc.). Les domaines concern\u00e9s devraient \u00eatre d\u00e9finis par d\u00e9cret dans les semaines \u00e0 venir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Un recours \u00e0 la VAE renforc\u00e9 pour atteindre le plein-emploi<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pouvant notamment \u00eatre financ\u00e9e par l&#8217;employeur, la <a href=\"https:\/\/www.vae.gouv.fr\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Validation des acquis de l&rsquo;exp\u00e9rience<\/em><\/a><a href=\"https:\/\/www.vae.gouv.fr\"> (VAE)<\/a> constitue <strong>l&rsquo;autre levier mobilis\u00e9 par le gouvernement pour atteindre le plein-emploi \u00e0 l\u2019horizon 2027<\/strong><sup>2<\/sup>. Utilis\u00e9 depuis 20 ans pour favoriser la promotion, l&rsquo;\u00e9volution et les transitions professionnelles, ce dispositif permet \u00e0 un salari\u00e9 d&rsquo;obtenir une certification gr\u00e2ce \u00e0 son exp\u00e9rience.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote has-text-align-center is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>100 000<\/strong><\/p><p>C&rsquo;est le nombre de VAE que le gouvernement souhaite atteindre chaque ann\u00e9e, contre 30 000 en 2021<sup>3<\/sup>.<\/p><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Le projet de loi instaure <strong>deux nouveaux dispositifs en vue d\u2019augmenter le nombre de b\u00e9n\u00e9ficiaires de VAE<\/strong>. Des dispositifs que les entreprises seront probablement encourag\u00e9es \u00e0 promouvoir en interne.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>La cr\u00e9ation d&rsquo;un service public de la VAE<\/strong> : les candidats auront acc\u00e8s \u00e0 une plateforme num\u00e9rique unique qui leur permettra d&rsquo;engager leurs d\u00e9marches de certification par le biais d&rsquo;une VAE.<\/li><li><strong>Une exp\u00e9rimentation de la VAE invers\u00e9e<\/strong> : d&rsquo;une dur\u00e9e de 3 ans, elle concernera uniquement les secteurs sous tension. Ce dispositif vise \u00e0 associer l&rsquo;alternance et la VAE afin que la r\u00e9alisation d&rsquo;un contrat de professionnalisation permette l\u2019obtention d\u2019une certification professionnelle.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Une diminution conjoncturelle de la dur\u00e9e d&rsquo;indemnisation<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Dans l\u2019optique de tendre vers le plein-emploi, le projet de loi apporte une derni\u00e8re nouveaut\u00e9 d\u2019importance : <strong>la baisse de 25 % de la dur\u00e9e maximum d&rsquo;indemnisation lorsque le march\u00e9 de l&#8217;emploi se porte bien<\/strong>. Plus concr\u00e8tement, cette r\u00e9duction conjoncturelle interviendra si le taux de ch\u00f4mage :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>est inf\u00e9rieur \u00e0 9 % ;<\/li><li>ou n&rsquo;a pas augment\u00e9 de 0,8 point sur un trimestre.<\/li><\/ul>\n\n\n\n<blockquote class=\"wp-block-quote has-text-align-center is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>7,3 %<\/strong> <\/p><p>C\u2019est le taux de ch\u00f4mage au 3<sup>e<\/sup> trimestre 2022 en France m\u00e9tropolitaine.
