Permettant de remplacer plusieurs salari\u00e9s par un seul contrat court, cette mesure permettrait de soulager des secteurs en tension. D\u00e9couvrez son fonctionnement et les questions qu\u2019elle soul\u00e8ve.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Qu\u2019est-ce qu\u2019un CDD multi-remplacements ?<\/strong><\/h2>\n\n\n\n<p class=\"\">En temps normal, un contrat court de remplacement ne peut \u00eatre <strong>utilis\u00e9 que pour faire face \u00e0 l\u2019absence d\u2019un seul salari\u00e9<\/strong>, comme le disposent les articles L. 1242\u20112 et L. 1251\u20116 du Code du travail. Cette situation peut notamment se produire lorsque le salari\u00e9 est :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>absent temporairement ou que son contrat est suspendu (cong\u00e9 maternit\u00e9, maladie, etc.) ;<\/li><li>provisoirement \u00e0 temps partiel (cong\u00e9 parental par exemple) ;<\/li><li>parti d\u00e9finitivement de l&rsquo;entreprise, dans l&rsquo;attente de la suppression du poste.<\/li><\/ul>\n\n\n\n<p class=\"\">Le dispositif pr\u00e9vu par le gouvernement entend modifier cette r\u00e8gle. <strong>Un seul contrat pourra d\u00e9sormais \u00eatre sign\u00e9 pour remplacer plusieurs salari\u00e9s<\/strong>, soit par le biais :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>d&rsquo;un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e (CDD) ;<\/li><li>ou d&rsquo;un contrat de mission.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Une exp\u00e9rimentation au go\u00fbt d\u2019inachev\u00e9<\/strong><\/h2>\n\n\n\n<p class=\"\">Souvent appel\u00e9 \u00ab <strong>CDD multi-remplacement<\/strong> \u00bb, bien qu&rsquo;il s&rsquo;applique aussi aux contrats de mission, ce dispositif devait faire l&rsquo;objet d&rsquo;une<strong> exp\u00e9rimentation entre le 1<sup>er <\/sup>janvier 2019 et le 31 d\u00e9cembre 2020<\/strong>. Celle-ci \u00e9tait pr\u00e9vue par l&rsquo;article 53 de la loi du 5 septembre 2018 pour la libert\u00e9 de choisir son avenir professionnel.<\/p>\n\n\n\n<p class=\"\">Le d\u00e9cret encadrant les secteurs \u00e9ligibles avait cependant mis du temps \u00e0 \u00eatre publi\u00e9. Intervenue seulement le 18 d\u00e9cembre 2019, cette publication tardive n&rsquo;a pas laiss\u00e9 suffisamment de temps aux entreprises pour participer \u00e0 l&rsquo;exp\u00e9rimentation, d\u2019autant plus avec le d\u00e9but de la crise sanitaire survenu en mars 2020.<\/p>\n\n\n\n<p class=\"\">L&rsquo;article 2 bis du <a href=\"https:\/\/www.assemblee-nationale.fr\/dyn\/16\/textes\/l16b0219_projet-loi\" target=\"_blank\" rel=\"noreferrer noopener\">Projet de loi portant mesures d\u2019urgence relatives au fonctionnement du march\u00e9 du travail en vue du plein emploi<\/a>, actuellement \u00e0 l&rsquo;\u00e9tude, pr\u00e9voit derelancer l&rsquo;exp\u00e9rimentation <strong>du CDD multi-remplacements pour une p\u00e9riode de 2 ans<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Sous quelles conditions avoir recours au CDD multi-remplacements ?<\/strong><\/h2>\n\n\n\n<p class=\"\">Comme le dispose le projet de loi, le CDD multi-remplacements <strong>ne vise pas \u00e0 pourvoir durablement un emploi li\u00e9 \u00e0 l\u2019activit\u00e9 normale<\/strong> et permanente de l\u2019entreprise. En revanche, le dispositif pourrait permettre de remplacer :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>plusieurs salari\u00e9s absents en m\u00eame temps ;<\/li><li>plusieurs salari\u00e9s absents successivement.<\/li><\/ul>\n\n\n\n<p class=\"\">L\u2019usage d\u2019un contrat court pour remplacer plusieurs salari\u00e9s ne pourra \u00eatre r\u00e9alis\u00e9 que par <strong>certains secteurs d\u2019activit\u00e9<\/strong>, <strong>d\u00e9finis par d\u00e9cret<\/strong>. Le d\u00e9cret n&rsquo;ayant pas encore \u00e9t\u00e9 publi\u00e9, les secteurs \u00e9ligibles devraient \u00eatre les m\u00eames que lors de l\u2019exp\u00e9rimentation en 2019.<sup>1<\/sup><strong>\u00c0 noter<\/strong> : \u00e0 l\u2019issue de l\u2019exp\u00e9rimentation, le gouvernement devra r\u00e9aliser un rapport d&rsquo;\u00e9valuation sur la mesure. Il vise notamment \u00e0 d\u00e9terminer les effets du dispositif sur la fr\u00e9quence de conclusion de contrats courts (CDD et contrats de mission) et sur l&rsquo;allongement de leur dur\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Un dispositif attendu par les secteurs frapp\u00e9s par l\u2019absent\u00e9isme<\/strong><\/h2>\n\n\n\n<p class=\"\">La relance de cette exp\u00e9rimentation semble \u00eatre salu\u00e9e par les secteurs concern\u00e9s, dans la mesure o\u00f9 elle r\u00e9pond \u00e0 un r\u00e9el besoin de simplification des d\u00e9marches administratives d&#8217;embauche et \u00e0 un absent\u00e9isme en hausse.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote has-text-align-center is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>6,19 %<\/strong><\/p><p>C\u2019\u00e9tait le taux d\u2019absent\u00e9isme en 2021, contre 4,55 % en 2015 et 5,54 en 2019, selon le barom\u00e8tre <a href=\"https:\/\/presse.ag2rlamondiale.fr\/actualites\/resultats-du-14e-barometre-de-labsenteisme-r-et-de-lengagement-ayming-ag2r-la-mondiale-f20e-3a203.html\" target=\"_blank\" rel=\"noreferrer noopener\">AYming\/AG2R de septembre 2022<\/a>. \u00c0 noter l\u2019enjeu pour les employeurs : 3,14 % des absences sont des absences de longue dur\u00e9e, dont presque la moiti\u00e9 repose sur des raisons professionnelles (accidents du travail, maladies professionnelles, burn-out\u2026)<\/p><\/blockquote>\n\n\n\n<p class=\"\">Le CDD devra probablement \u00eatre conclu d\u2019ici peu, eu \u00e9gard aux \u00e9ch\u00e9ances des diff\u00e9rentes absences des salari\u00e9s remplac\u00e9s.
