Bien ma\u00eetriser les cas de figure concern\u00e9s \u00e9vite autant l\u2019op\u00e9ration non conforme que le manque \u00e0 gagner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans son principe, la TVA non d\u00e9ductible s\u2019applique \u00e0 quelques familles de biens. Plus contrariant, l\u2019impossibilit\u00e9 de d\u00e9duction peut aussi provenir d\u2019une facture mal libell\u00e9e par votre fournisseur. Les d\u00e9penses personnelles et celles dont l\u2019usage professionnel est inf\u00e9rieur \u00e0 10 % sont explicitement exclues du b\u00e9n\u00e9fice de d\u00e9duction de la TVA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le <a href=\"https:\/\/bofip.impots.gouv.fr\/bofip\/1196-PGP.html\/identifiant=BOI-TVA-DED-30-30-50-20120912\" target=\"_blank\" rel=\"noreferrer noopener\">Bulletin Officiel des Finances Publiques<\/a> propose un inventaire exhaustif des situations d\u2019exclusion et des d\u00e9rogations qui s\u2019appliquent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ce qu\u2019il faut retenir, c\u2019est que 4 types d\u2019achats de biens ou de services g\u00e9n\u00e8rent une TVA non r\u00e9cup\u00e9rable&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les <strong>d\u00e9penses de logement induites par des d\u00e9placements professionnels<\/strong> des dirigeants ou de salari\u00e9s de l\u2019entreprise.<\/li>\n\n\n\n<li>Les <strong>automobiles de tourisme utilis\u00e9es dans un contexte professionnel<\/strong>. Ce n\u2019est pas le cas des v\u00e9hicules utilitaires, pour les loueurs de v\u00e9hicules ou pour les soci\u00e9t\u00e9s de transport de voyageurs.<\/li>\n\n\n\n<li>Les <strong>frais li\u00e9s au transport de personnes<\/strong>, quel que soit le mode de transport (train, autocar, avion, m\u00e9tro, taxi\u2026). La TVA sur les frais de p\u00e9age est en revanche r\u00e9cup\u00e9rable.<\/li>\n\n\n\n<li>Les <strong>cadeaux \u00e0 vos clients de plus de 60 euros<\/strong> TTC.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Une facture non conforme, motif d\u2019exclusion co\u00fbteux pour le client<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Bien entendu, la TVA <strong>ne peut \u00eatre r\u00e9cup\u00e9rable que si l\u2019entreprise est soumise \u00e0 la TVA<\/strong> et la collecte sur ses ventes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans cette hypoth\u00e8se, tous les achats non express\u00e9ment exclus ouvrent droit \u00e0 r\u00e9cup\u00e9ration de TVA. Pour autant, m\u00eame sur ces biens ou ces services, <strong>la TVA devient non d\u00e9ductible si la <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/dematerialisation-factures-fournisseurs-guide\/\">facture du fournisseur<\/a> n\u2019est pas conforme<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Observons que dans la perspective de la mise en place de la <a href=\"https:\/\/www.sage.com\/fr-fr\/dematerialisation\/facture-electronique\/\">facture \u00e9lectronique<\/a>, <strong>toute facture non conforme sera bloqu\u00e9e en amont, d\u00e8s la <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/plateforme-de-dematerialisation-portail-public\/\">Plateforme de D\u00e9mat\u00e9rialisation Partenaire (PDP)<\/a><\/strong>. Mais pour la p\u00e9riode transitoire qui court jusqu\u2019\u00e0 la date d\u2019entr\u00e9e en vigueur, il est utile de conna\u00eetre les motifs d\u2019exclusion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4 informations doivent n\u00e9cessairement figurer sur la facture pour vous permettre de r\u00e9cup\u00e9rer la TVA&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le montant hors taxes de la facture<\/li>\n\n\n\n<li>Le montant de la TVA<\/li>\n\n\n\n<li>Les taux de TVA appliqu\u00e9s<\/li>\n\n\n\n<li>Le montant toutes taxes comprises de la facture<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Au fait, de votre c\u00f4t\u00e9, \u00eates-vous en conformit\u00e9 avec la <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/loi-lutte-contre-fraude-tva-dernieres-precisions-2017\/\">loi anti-fraude \u00e0 la TVA&nbsp;<\/a>?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>En conclusion, la TVA non d\u00e9ductible s\u2019applique \u00e0 quelques cas bien identifi\u00e9s. <\/strong>Une <a href=\"https:\/\/www.sage.com\/fr-fr\/comptabilite-logiciels\/\">solution de gestion conforme<\/a> sera d\u2019un grand secours pour automatiser la production de d\u00e9clarations de TVA respectueuses des r\u00e8gles. Elle vous garantit le juste acquittement de la taxe, ni trop, ni trop peu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De plus, avec la mise en place de la facture \u00e9lectronique, vous \u00eates assur\u00e9 de ne recevoir que des factures conformes.
