Pourtant, il n&rsquo;est pas rare que le d\u00e9lai de facturation soit source de confusion, voire de n\u00e9gligence. Entre les obligations du Code de commerce et celles du Code g\u00e9n\u00e9ral des imp\u00f4ts, il est essentiel de bien comprendre les r\u00e8gles en vigueur pour \u00e9viter tout \u00e9cueil.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"#loi\">Ce que dit la loi ?<\/a><\/li>\n\n\n\n<li><a href=\"#pourquoi\">Pourquoi facturer rapidement&nbsp;?<\/a><\/li>\n\n\n\n<li><a href=\"#difference\">La diff\u00e9rence entre le d\u00e9lai de facturation et le d\u00e9lai de paiement ?<\/a><\/li>\n\n\n\n<li><a href=\"#facture\">La facture \u00e9lectronique ?<\/a><\/li>\n<\/ul>\n\n\n\n<h2 id=\"loi\" class=\"wp-block-heading\"><strong>Ce que dit la loi sur les d\u00e9lais de facturation<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Selon <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000005634379\/LEGISCTA000038411051\/\" target=\"_blank\" rel=\"noreferrer noopener\">le Code de commerce<\/a>, la <strong>facture<\/strong> est obligatoire pour chaque vente. Mais qu\u2019en est-il du <strong>d\u00e9lai de facturation<\/strong>&nbsp;?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Selon le Code g\u00e9n\u00e9ral des imp\u00f4ts, la <strong>facture <\/strong>est \u00e0 \u00e9tablir d\u00e8s la r\u00e9alisation de la livraison ou de la prestation de services, ou au plus tard le 15 du mois suivant, pour les livraisons de biens exon\u00e9r\u00e9es de TVA et les prestations de services pour lesquelles la taxe est due par le client.<br>En cas de <strong>facturation<\/strong> p\u00e9riodique pour plusieurs prestations, le d\u00e9lai d\u2019\u00e9mission d\u2019une facture court au plus tard \u00e0 la fin du mois.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En r\u00e8gle g\u00e9n\u00e9rale, la loi pr\u00e9voit que les <strong>factures<\/strong> soient envoy\u00e9es 15 jours apr\u00e8s la date de livraison, et un mois grand maximum pour les entreprises qui facturent en fin de mois pour des raisons comptables.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote has-text-align-left\"><blockquote><p>Le manquement \u00e0 cette obligation de <strong>d\u00e9lai de facturation<\/strong> est passible d\u2019une amende administrative de 75 000 \u20ac pour une personne physique et 375 000 \u20ac pour une personne morale qui peut \u00eatre doubl\u00e9e en cas de r\u00e9cidive.<\/p><cite>Article L441-9 du Code du commerce<\/cite><\/blockquote><\/figure>\n\n\n\n<h2 id=\"pourquoi\" class=\"wp-block-heading\"><strong>Pourquoi facturer rapidement&nbsp;?<\/strong><\/h2>\n\n\n\n<p diff\u00e9rence entre le d\u00e9lai de facturation et le d\u00e9lai de paiement ?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Incontournable en cas de vente, la facture est soumise \u00e0 des r\u00e8gles notamment celle d\u2019\u00eatre \u00e9tablie selon un <strong>d\u00e9lai de facturation, <\/strong>\u00e0 ne pas confondre avec le <strong>d\u00e9lai de paiement.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le <strong>d\u00e9lai de facturation<\/strong>&nbsp;est le d\u00e9lai maximal pour envoyer une facture au client une fois la vente ou la<br>prestation de services effectu\u00e9s.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le <strong>d\u00e9lai de paiement<\/strong> est le d\u00e9lai dont le client dispose pour effectuer son r\u00e8glement, c\u2019est-\u00e0-dire pour payer sa facture.<br>Il ne peut d\u00e9passer 60 jours apr\u00e8s r\u00e9ception ou ex\u00e9cution de la prestation ou \u00e0 titre d\u00e9rogatoire 45 jours fin de mois (soit date de facture + 45 jours + fin du mois, soit date de facture + fin du mois + 45 jours).<br>En cas de facture p\u00e9riodique, le <strong>d\u00e9lai de paiement <\/strong>ne peut d\u00e9passer 45 jours apr\u00e8s la date de <strong>facturation.<\/strong><\/p>\n\n\n\n<h2 id=\"h-et-avec-la-facture-electronique\" class=\"wp-block-heading\"><strong>Et avec la facture \u00e9lectronique ?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Initialement pr\u00e9vue au 1<sup>er<\/sup>&nbsp;juillet&nbsp;2024, l&rsquo;obligation pour les entreprises \u00e9tablies en France d&rsquo;\u00e9mettre et de recevoir des factures \u00e9lectroniques s&rsquo;appliquera progressivement \u00e0 partir du 1<sup>er<\/sup>&nbsp;septembre&nbsp;2026 pour l\u2019ensemble des entreprises, quelle que soit leur taille.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Une&nbsp;<a href=\"https:\/\/www.sage.com\/fr-fr\/dematerialisation\/facture-electronique\/\"><strong>facture<\/strong> \u00e9lectronique&nbsp;<\/a>c\u2019est-\u00e0-dire d\u00e9mat\u00e9rialis\u00e9e<strong> <\/strong>reste une&nbsp;<strong>facture.<\/strong> Les obligations et donc les <strong>d\u00e9lais de facturation<\/strong> et de <strong>paiement<\/strong> restent les
