Les TPE et PME n\u2019\u00e9chappent pas \u00e0 la r\u00e8gle&nbsp;: vous pouvez profiter de ce moment pour v\u00e9rifier votre conformit\u00e9 aux principales r\u00e9glementations num\u00e9riques (facturation \u00e9lectronique, DSN, etc.). Un r\u00e9flexe d\u2019autant plus important que de nombreuses entreprises ne sont toujours pas dans les clous.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"#rgpd\">Le RGPD (R\u00e8glement G\u00e9n\u00e9ral sur la Protection des Donn\u00e9es)<\/a><\/li>\n\n\n\n<li><a href=\"#dsn\">La DSN (D\u00e9claration Sociale Nominative)<\/a><\/li>\n\n\n\n<li><a href=\"#facture\">La facture \u00e9lectronique<\/a><\/li>\n<\/ul>\n\n\n\n<div class=\"single-cta\">\n\t<a\n\t\tclass=\"button button--primary gate-da356355-81fc-485f-9a77-1aadab4eec10\"\n\t\trole=\"button\"\n\t\tdata-button-location=\"content_area\"\n\t\thref=\"#gate-da356355-81fc-485f-9a77-1aadab4eec10\"\n\t>T\u00e9l\u00e9chargez le guide pour tout savoir sur la transformation digitale des PME<\/a>\n<\/div>\n\n\n\n\n<h2 class=\"wp-block-heading\" id=\"rgpd\"><strong>R\u00e9glementation num\u00e9rique n\u00b01 : le RGPD<\/strong><\/h2>\n\n\n\n<p>Bien qu&rsquo;il soit en vigueur depuis le 25 mais 2018, le R\u00e8glement g\u00e9n\u00e9ral sur la protection des donn\u00e9es (RGPD) est encore loin d&rsquo;\u00eatre conform\u00e9ment appliqu\u00e9 par toutes les organisations. Or, <strong>cette r\u00e9glementation visant \u00e0 prot\u00e9ger les donn\u00e9es personnelles concerne toutes les entreprises<\/strong>, y compris celles dont l&rsquo;activit\u00e9 n&rsquo;implique pas de traiter des donn\u00e9es. Par exemple, vous \u00eates concern\u00e9 si vous avez au moins un salari\u00e9 car vous avez besoin de collecter certaines de ses informations personnelles.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote has-text-align-center\"><blockquote><p><strong>42 sanctions <\/strong>ont \u00e9t\u00e9 prononc\u00e9es et 168 mises en demeure ont \u00e9t\u00e9 adress\u00e9es par la Cnil pour non-respect du RGPD en 2023*<\/p><cite>*Rapport annuel 2023 &#8211; Commission nationale de l&rsquo;informatique et des libert\u00e9s &#8211; 2024<\/cite><\/blockquote><\/figure>\n\n\n\n<p>Pourtant, pour les petites et moyennes entreprises, <strong>les mesures \u00e0 mettre en \u0153uvre pour se mettre en conformit\u00e9 ne sont pas si lourdes<\/strong>, comme le souligne la Cnil dans son <a href=\"https:\/\/www.cnil.fr\/sites\/cnil\/files\/atoms\/files\/bpi-cnil-rgpd_guide-tpe-pme.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Guide pratique de sensibilisation au RGPD pour les PME<\/a>. \u00c0 travers celui-ci, le r\u00e9gulateur dresse les 4 actions principales \u00e0 mener.<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Cr\u00e9er un registre<\/strong> pour d\u00e9finir les activit\u00e9s qui impliquent de traiter des donn\u00e9es personnelles (recrutement, gestion de la paie, etc.), l&rsquo;objectif de la collecte et la nature des donn\u00e9es (nom, pr\u00e9nom, adresse, num\u00e9ro de S\u00e9curit\u00e9 sociale, etc.).<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Faire le tri dans les donn\u00e9es<\/strong> en supprimant celles qui ne sont pas utiles \u00e0 l&rsquo;activit\u00e9 et en r\u00e9duisant les informations collect\u00e9es \u00e0 leur strict n\u00e9cessaire.<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Respecter le droit des personnes<\/strong>, notamment en donnant le droit aux individus d&rsquo;avoir acc\u00e8s \u00e0 leurs donn\u00e9es personnelles.<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>S\u00e9curiser les donn\u00e9es<\/strong> via diff\u00e9rentes actions (mise \u00e0 jour des logiciels, modification r\u00e9guli\u00e8re des mots de passe, etc.).<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"dsn\"><strong>R\u00e9glementation num\u00e9rique n\u00b02 : les nouveaut\u00e9s de la DSN<\/strong><\/h2>\n\n\n\n<p>Obligatoire pour toutes les entreprises depuis 2017, la <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/glossaire\/dsn-definition-de-la-dsn-declaration-sociale-nominative\/#:~:text=et%20en%20autonomie-,DSN%20%3A%20d%C3%A9claration%20sociale%20nominative,et%20des%20signalements%20d'%C3%A9v%C3%A9nements.\"><strong>D\u00e9claration sociale nominative<\/strong><\/a> permet de transmettre les principales donn\u00e9es issues de la paie et de signaler certains \u00e9v\u00e9nements (arr\u00eat maladie, etc.). Or, <strong>le p\u00e9rim\u00e8tre de la DSN s\u2019\u00e9largit r\u00e9guli\u00e8rement, pouvant impacter la conformit\u00e9 des TPE et PME<\/strong>. Plusieurs exemples des <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/dsn-evolutions-comment-assurer-sa-conformite\/\">\u00e9volutions r\u00e9centes de la DSN<\/a> qu\u2019il vous faut prendre en compte&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>le solde de la taxe d&rsquo;apprentissage \u00e0 d\u00e9clarer tous les mois ;<\/li>\n\n\n\n<li>la contribution suppl\u00e9mentaire \u00e0 l&rsquo;apprentissage \u00e0 d\u00e9clarer en d\u00e9but d&rsquo;ann\u00e9e ;<\/li>\n\n\n\n<li>la d\u00e9claration du montant net social, int\u00e9gr\u00e9 depuis juillet 2023 dans <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/bulletin-de-paie-clarifie-2025\/\">le nouveau bulletin de paie clarifi\u00e9<\/a> ;<\/li>\n\n\n\n<li>la d\u00e9claration des heures suppl\u00e9mentaires exon\u00e9r\u00e9es \u00e0 r\u00e9aliser avec les \u00e9l\u00e9ments de revenu calcul\u00e9 en net ;<\/li>\n\n\n\n<li>l&rsquo;inclusion des indemnit\u00e9s journali\u00e8res de S\u00e9curit\u00e9 sociale dans la rubrique consacr\u00e9e au PAS (pr\u00e9l\u00e8vement \u00e0 la source).<\/li>\n<\/ul>\n\n\n\n<p>Pour les entreprises qui ne seraient pas encore \u00e0 jour de toutes ces \u00e9volutions, deux r\u00e9flexes s\u2019imposent&nbsp;: <strong>s&rsquo;\u00e9quiper d&rsquo;un <\/strong><a href=\"https:\/\/www.sage.com\/fr-fr\/paie-logiciels-gestion\/dsn\/\"><strong>logiciel de gestion de la paie compatible DSN<\/strong><\/a> et s&rsquo;assurer de la qualit\u00e9 des donn\u00e9es int\u00e9gr\u00e9es dans celle-ci. Mise \u00e0 jour r\u00e9guli\u00e8rement par votre fournisseur, cette solution digitale de gestion de la paie vous permet de garantir votre conformit\u00e9, sans intervention de votre part.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"facture\"><strong>R\u00e9glementation num\u00e9rique n\u00b03 : le chantier urgent de la facture \u00e9lectronique<\/strong><\/h2>\n\n\n\n<p>Malgr\u00e9 le report du calendrier, l&rsquo;\u00e9ch\u00e9ance pour se conformer \u00e0 la facturation \u00e9lectronique obligatoire est de plus en plus proche. Non seulement ce chantier ne se traite pas en un jour, mais ses b\u00e9n\u00e9fices encouragent les entreprises \u00e0 l\u2019anticiper. Pour les TPE et PME, vous avez en effet l&rsquo;obligation de :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>recevoir les factures \u00e9lectroniques d\u00e8s le 1<sup>er<\/sup> septembre 2026 ;<\/li>\n\n\n\n<li>\u00e9mettre des factures \u00e9lectroniques \u00e0 partir du 1<sup>er <\/sup>d\u00e9cembre 2027 ;<\/li>\n\n\n\n<li>transmettre les donn\u00e9es de facturation (e-reporting) \u00e0 partir du 1<sup>er<\/sup> septembre 2027.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-pullquote has-text-align-center\"><blockquote><p><strong>12 mois<\/strong> : c&rsquo;est la dur\u00e9e minimale que le processus de transition demandera pour 59 % des entreprises*.<\/p><cite>*Les entreprises tr\u00e8s en retard pour la facturation \u00e9lectronique &#8211; R\u00e9publik IT &#8211; 2024<\/cite><\/blockquote><\/figure>\n\n\n\n<p>Un sondage r\u00e9alis\u00e9 par OpinionWay r\u00e9v\u00e8le que seulement <strong>2 % des entreprises d&rsquo;au moins 10 salari\u00e9s sont aujourd&rsquo;hui en conformit\u00e9<\/strong> avec cette future obligation. Une situation probl\u00e9matique dans la mesure o\u00f9 l\u2019adoption de la e-facturation et du e-reporting exige du temps et de nombreuses \u00e9volutions, dont&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>l&rsquo;audit du syst\u00e8me d&rsquo;information ;<\/li>\n\n\n\n<li>la mise \u00e0 jour de la base de donn\u00e9es clients et fournisseurs ;<\/li>\n\n\n\n<li>l&rsquo;ajout des nouvelles mentions obligatoires sur les factures ;<\/li>\n\n\n\n<li>la mise en place d&rsquo;un mode de transmission des factures adapt\u00e9 \u00e0 votre organisation.<\/li>\n<\/ul>\n\n\n\n<p><strong>Vous utilisez d\u00e9j\u00e0 une solution Sage ?
