Autrement dit, l&#8217;employeur avance les sommes dues au salari\u00e9, puis en r\u00e9cup\u00e8re le montant aupr\u00e8s des organismes concern\u00e9s.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-est-ce-que-la-subrogation-est-obligatoire\"><strong>Est-ce que la subrogation est obligatoire ?<\/strong><\/h3>\n\n\n\n<p>La subrogation n\u2019est pas une obligation l\u00e9gale, sauf si elle est impos\u00e9e par la convention collective de l&rsquo;entreprise ou un accord de branche. Certaines entreprises peuvent choisir de l&rsquo;appliquer pour faciliter la gestion des absences de leurs salari\u00e9s.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-comment-ca-fonctionne-la-subrogation-de-salaire\"><strong>Comment \u00e7a fonctionne <\/strong>la subrogation de salaire<strong>?<\/strong><\/h2>\n\n\n\n<p>Selon le <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043356691\" target=\"_blank\" rel=\"noreferrer noopener\">Code de la S\u00e9curit\u00e9 Sociale<\/a>, pour b\u00e9n\u00e9ficier de la subrogation de salaire, certaines conditions doivent \u00eatre remplies, tant du c\u00f4t\u00e9 de l&#8217;employeur que du salari\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-le-salarie\"><strong>Le salari\u00e9<\/strong><\/h3>\n\n\n\n<p>Le salari\u00e9 doit \u00e9galement avoir au moins 1 an d&rsquo;anciennet\u00e9(sauf si la convention collective ou l&rsquo;accord d&rsquo;entreprise pr\u00e9voient des dispositions plus favorables) et \u00eatre assur\u00e9 \u00e0 la S\u00e9curit\u00e9 sociale.<\/p>\n\n\n\n<p>Il doit transmettre \u00e0 son employeur, dans les d\u00e9lais l\u00e9gaux, un arr\u00eat de travail valid\u00e9 justifiant des indemnit\u00e9s journali\u00e8res vers\u00e9es par la S\u00e9curit\u00e9 sociale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-l-employeur\"><strong>L\u2019employeur<\/strong><\/h3>\n\n\n\n<p>L\u2019employeur doit faire la demande de subrogation quand il signale l\u2019arr\u00eat de travail dans la <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/glossaire\/dsn-definition-de-la-dsn-declaration-sociale-nominative\/\">D\u00e9claration Sociale Nominative<\/a> (DSN).<\/p>\n\n\n\n<p>Il indique la p\u00e9riode de la subrogation&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la date de d\u00e9but correspond au d\u00e9but de l\u2019arr\u00eat de travail<\/li>\n\n\n\n<li>la date de fin correspond au terme de l\u2019obligation de maintien de salaire. En effet, la date de fin de la subrogation ne correspond pas n\u00e9cessairement \u00e0 la date de fin de l\u2019arr\u00eat de travail.<\/li>\n<\/ul>\n\n\n\n<p>Si la subrogation n\u2019est pas pr\u00e9vue au contrat de travail ou la convention collective, le salari\u00e9 doit donner son accord dans le cas d\u2019un maintien de salaire est partiel.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-comment-gerer-la-subrogation-de-salaire-en-paie\"><strong>Comment g\u00e9rer la subrogation de salaire en paie ?<\/strong><\/h2>\n\n\n\n<p>Voici les \u00e9tapes \u00e0 suivre pour \u00e9tablir correctement un <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/expliquer-bulletin-paie-clarifie\/\">bulletin de paie<\/a> lorsque la subrogation de salaire est en place.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-le-montant-du-salaire-a-maintenir\"><strong>Le montant du salaire \u00e0 maintenir\u00a0<\/strong><\/h3>\n\n\n\n<p>L&#8217;employeur doit d\u00e9terminer le montant du salaire \u00e0 maintenir pendant l&rsquo;arr\u00eat de travail. Selon les dispositions l\u00e9gales ou conventionnelles, cela peut correspondre \u00e0 un maintien total ou partiel du salaire qui sera d\u00e9termin\u00e9 en fonction des conventions collectives ou accords d&rsquo;entreprise. Il convient donc de v\u00e9rifier les conditions applicables.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-la-fiche-de-paie\"><strong>La fiche de paie<\/strong><\/h3>\n\n\n\n<p>Les IJSS sont d\u00e9duites du <a href=\"https:\/\/www.sage.com\/fr-fr\/blog\/glossaire\/salaire-brut-salaire-net-definition-et-calcul\/\">salaire brut<\/a> pour indiquer que l&#8217;employeur ne paye que la diff\u00e9rence entre le salaire maintenu et les indemnit\u00e9s vers\u00e9es par la S\u00e9curit\u00e9 sociale ou la pr\u00e9voyance.<\/p>\n\n\n\n<p>Sur le bulletin de salaire, la subrogation se pr\u00e9sente g\u00e9n\u00e9ralement ainsi :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Salaire brut habituel qui serait per\u00e7u si le salari\u00e9 n&rsquo;\u00e9tait pas en arr\u00eat de travail.<\/li>\n\n\n\n<li>Indemnit\u00e9s journali\u00e8res S\u00e9curit\u00e9 sociale (IJSS) qui sont d\u00e9duites du salaire brut pour refl\u00e9ter le montant que la S\u00e9curit\u00e9 sociale verse directement \u00e0 l&#8217;employeur.<\/li>\n\n\n\n<li>Compl\u00e9ment employeur (maintien du salaire) : il s&rsquo;agit de la diff\u00e9rence entre le salaire maintenu et les IJSS.
