Elle permet \u00e0 l\u2019employeur de v\u00e9rifier les comp\u00e9tences du salari\u00e9 dans son poste, et au salari\u00e9 d\u2019appr\u00e9cier si les missions lui conviennent.<\/p>\n\n\n\n<section class=\"wp-block-sage-container is-constrained is-style-bordered\"><div class=\"sage-container__inner\">\n<p><strong>Bon \u00e0 savoir\u00a0!<\/strong><br>\u00a0La p\u00e9riode d\u2019essai n\u2019est pas automatique. Elle doit \u00eatre stipul\u00e9e dans le contrat de travail ou la lettre d\u2019engagement. \u00c0 d\u00e9faut, le salari\u00e9 est consid\u00e9r\u00e9 comme d\u00e9finitivement embauch\u00e9 d\u00e8s le premier jour.<\/p>\n<\/div><\/section>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"duree\"><strong>Quelle est la dur\u00e9e maximale de la p\u00e9riode d\u2019essai en CDI ?<\/strong><\/h2>\n\n\n\n<p>La dur\u00e9e de la p\u00e9riode d\u2019essai d\u00e9pend du statut du salari\u00e9. Le Code du travail pr\u00e9voit les dur\u00e9es suivantes (hors dispositions conventionnelles plus favorables).<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-data\"><table><thead><tr><th>Cat\u00e9gorie<\/th><th>Dur\u00e9e initiale<\/th><th>Renouvellement possible<\/th><th>Dur\u00e9e totale maximale<\/th><\/tr><\/thead><tbody><tr><td>Non cadre<\/td><td>2 mois maximum<\/td><td>2 mois maximum (1 fois)<\/td><td>4 mois<\/td><\/tr><tr><td>Agent de ma\u00eetrise et technicien<\/td><td>2 mois maximum<\/td><td>3 mois maximum<\/td><td>6 mois<\/td><\/tr><tr><td>Cadre<\/td><td>4 mois maximum<\/td><td>4 mois maximum<\/td><td>8 mois<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-cas-particuliers\"><strong>Cas particuliers<\/strong><\/h3>\n\n\n\n<p>Si un salari\u00e9 passe d\u2019un CDD \u00e0 un CDI sur le m\u00eame poste, la p\u00e9riode d\u2019essai du CDI peut \u00eatre r\u00e9duite voire supprim\u00e9e, notamment si les missions sont identiques.<\/p>\n\n\n\n<p>En outre, un arr\u00eat maladie interrompt la p\u00e9riode d\u2019essai. Celle-ci est <strong>prolong\u00e9e d\u2019une dur\u00e9e \u00e9quivalente<\/strong> \u00e0 l\u2019absence, sauf disposition conventionnelle contraire. Cependant, la rupture durant l\u2019arr\u00eat maladie peut \u00eatre contest\u00e9e si elle semble li\u00e9e \u00e0 l\u2019\u00e9tat de sant\u00e9 du salari\u00e9.<\/p>\n\n\n\n<p>Enfin, certaines conventions collectives peuvent pr\u00e9voir des dur\u00e9es diff\u00e9rentes, sous r\u00e9serve de respecter les r\u00e8gles de faveur pour le salari\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"renouvellement\"><strong>Le renouvellement de la p\u00e9riode d\u2019essai : sous quelles conditions ?<\/strong><\/h2>\n\n\n\n<p>Le renouvellement de la p\u00e9riode d\u2019essai n\u2019est pas automatique. Il doit respecter plusieurs conditions cumulatives :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00catre pr\u00e9vu dans la convention collective applicable ;<\/li>\n\n\n\n<li>\u00catre pr\u00e9vu dans le contrat de travail sign\u00e9 d\u00e8s l\u2019embauche ;<\/li>\n\n\n\n<li>Faire l\u2019objet d\u2019un accord \u00e9crit entre les deux parties avant la fin de la p\u00e9riode initiale.<\/li>\n<\/ul>\n\n\n\n<p><strong>Sans respect de ces conditions, toute prolongation est consid\u00e9r\u00e9e comme nulle.<\/strong><\/p>\n\n\n\n<p>Par exemple, un contrat mentionnant une p\u00e9riode d\u2019essai de 4 mois pour un cadre, renouvelable 4 mois, ne peut \u00eatre valablement renouvel\u00e9 que si le salari\u00e9 signe un accord de renouvellement avant la fin des 4 mois initiaux.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"obligations\"><strong>Les obligations l\u00e9gales pendant la p\u00e9riode d\u2019essai<\/strong><\/h2>\n\n\n\n<p>Durant la p\u00e9riode d\u2019essai, le salari\u00e9 b\u00e9n\u00e9ficie des droits classiques d\u2019un CDI, notamment :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Une r\u00e9mun\u00e9ration au moins \u00e9quivalente au <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F2300\" target=\"_blank\" rel=\"noreferrer noopener\">SMIC <\/a>ou au minimum conventionnel ;<\/li>\n\n\n\n<li>Protection contre les discriminations ;<\/li>\n\n\n\n<li>Acc\u00e8s \u00e0 la formation et aux \u00e9quipements n\u00e9cessaires ;<\/li>\n\n\n\n<li>Cong\u00e9s pay\u00e9s (acquis mais g\u00e9n\u00e9ralement non pris sur cette p\u00e9riode) ;<\/li>\n\n\n\n<li>Acc\u00e8s \u00e0 la m\u00e9decine du travail et aux r\u00e8gles de sant\u00e9\/s\u00e9curit\u00e9.<\/li>\n<\/ul>\n\n\n\n<p>L\u2019employeur doit \u00e9galement respecter les d\u00e9lais de pr\u00e9venance en cas de rupture, m\u00eame durant la p\u00e9riode d\u2019essai.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"rupture\"><strong>Rupture de la p\u00e9riode d\u2019essai : comment \u00e7a marche ?<\/strong><\/h2>\n\n\n\n<p>La p\u00e9riode d\u2019essai peut \u00eatre rompue <strong>librement<\/strong> par l\u2019une ou l\u2019autre des parties, <strong>sans avoir \u00e0 motiver<\/strong> la d\u00e9cision.
