If you acquired a license to Microsoft SQL Server, then this Microsoft SQL Server user agreement applies to your use of Microsoft SQL Server. If you acquired a trial copy of Microsoft SQL Server, you may not use the trial copy for more than 120 days.
If you acquired a license to Sage Enterprise Intelligence (SEI), the following additional terms apply to you:
Backup.
For the purposes hereof:
(i) “Customer Data” shall mean the data, information or material provided, inputted or submitted by you or on your behalf into the Software, which may include data relating to your customers and/or employees;
(ii) “Software” means collectively Sage Enterprise Intelligence (SEI), and the relevant documentation; and
(iii) “Software Data” means data that relates to the operation or configuration the Software.
For SEI provided as an on-premises software, you are responsible to have and maintain in place industry standard backup/disaster recovery processes for Customer Data and Software Data, including for reconstruction of lost or altered source data.
For SEI provided as a cloud services, you are responsible to keep copies (in any relevant format) of all source data that is submitted/entered by you or your representatives on the Software and to have and maintain in place industry standard backup/disaster recovery processes for Customer Data (including for the reconstruction of lost or altered source data). Sage (or its licensors and suppliers, as applicable) is responsible to have and maintain in place industry standard backup/disaster recovery processes for Software Data; provided, however, that Sage (or its licensors and suppliers, as applicable) shall only be obligated to provide you the same backup/disaster recovery standards as those provided by Sage’s hosting providers.
You acknowledge and agree that You assume all risks associated with the use of and reliance on any Database delivered by Sage. All Databases are provided “AS IS” with no express or implied warranties whatsoever. Neither Sage nor its Database Providers (including but not limited to NECA, i2, and RS Means) shall be responsible or liable for (i) any errors in: productivity rates, pricing, calculations, documentation, any other data, or the transcription of same (collectively “Data”) included in any Database delivered by Sage; or (ii) for any damages suffered by You or any party claiming through You, arising from Your reliance on the Data and Your failure to obtain correct or updated Data. You remain solely responsible for the accuracy, applicability, review of, and results obtained from using the Data. You hereby release Sage and its Data Providers from and waive any right to assert any claim under any legal theory which may arise against Sage and/or its Data Providers by reason of Your use of or reliance on the Database and/or the Data.
You may install the Software on a single computer for access and Use by a single user, or on a single server for concurrent access and Use over a network by multiple users, so long as the number of users at any one time does not exceed the number of "Uses" You pay for.

You may use the Software, with some limitations and without registration, in demonstration mode for up to one ninety (90)-day period following installation. If the Software is not registered within this time, You must uninstall and remove the Software. You agree that any user consents to the terms of the License. For each license to use the Software on a “named” basis that You purchased, Sage grants You the right to designate a single named user, which may change from time to time. That user is granted, a personal, nonexclusive license to use one copy of the Software on a single installation of the product. You may install the client Software on multiple machines provided that the Software is used only by named user.

The database in the Program is provided by Pervasive Software, Inc. (“Pervasive”). As part of its effort to ensure activation of valid software licenses, Pervasive will collect software and system information, including, but not limited to, information about your hardware, network, and operating system to uniquely associate the computer with your Pervasive licenses. Data is also collected during uninstalls, product updates, and any license management. No personal identity information is collected.
The Supplemental License Terms for Sage CRM include the terms of the Apache Software License, Version 1.1. (Download the license)
If you acquired a license to Microsoft SQL Server, then this Microsoft SQL Server user agreement applies to your use of Microsoft SQL Server. If you acquired a trial copy of Microsoft SQL Server, you may not use the trial copy for more than 120 days.
The following terms apply to any customer (individual or entity) (“Customer” or “you”) that licenses RSMeans® construction cost data and associated proprietary information (“Cost Data”) as part of Customer’s purchase/license of software (“Software”) from Sage . Through a license granted by R.S. Means Company LLC (“RSMeans”), Sage grants Customer a sublicense under the following terms, which defines Customer’s rights to access and use the Cost Data.
IMPORTANT: Carefully read this license before accessing or using any portion of the Cost Data. Accessing and/or using the Cost Data within the Software indicates your acknowledgment that you have read this Addendum and agree to its terms. If you do not agree, return the Cost Data (together with your proof of purchase) complete to Sage before installing and accessing it, for a full refund. This Addendum is proof of your license. Please treat the Cost Data as valuable property.
A. LICENSE: Sage, pursuant to an agreement with RSMeans, provides Customer a non-exclusive, non-transferable, limited sublicense, for the term of its license to the Sage Software, to use and display the Cost Data contained with the Software, provided that you fully comply with this Addendum. Customer’s license allows for the use and display of the Cost Data made available in the Software solely for use in the regular course of construction estimating and related work.

Except for the sublicense granted in this Addendum, all rights, title, and interest in the Cost Data, in all formats and media throughout the world, including all copyrights, are and will continue to be the exclusive property of RSMeans.
EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, THE COST DATA IS PROVIDED AS-IS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, COMPATIBILITY, SECURITY, ACCURACY,OR NON-INFRINGEMENT. To the fullest extent permissible by law, RSMeans and its affiliates shall not be liable for your use of the Cost Data under any circumstances, including, but not limited to, by reason of the negligence by RSMeans. RSMeans does not warrant that defects will be corrected, or that the Cost Data will meet any particular criteria of performance or quality.
USE OF THE COST DATA IS AT YOUR OWN RISK. YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS RESULTING FROM YOUR DOWNLOADING AND/OR USE OF FILES, INFORMATION, COMMUNICATIONS, CONTENT, OR OTHER MATERIAL ACCESSED THROUGH OR OBTAINED BY MEANS OF THE SOFTWARE. UNDER NO CIRCUMSTANCES SHALL RSMEANS OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE, THE COST DATA, EVEN IF RSMEANS, ITS AFFILIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL LIABILITY OF RSMEANS AND ITS AFFILIATES HEREUNDER IS LIMITED TO THE AMOUNT, IF ANY, ACTUALLY PAID BY YOU FOR ACCESS AND USE OF THE COST DATA DURING THE TWELVE MONTH PERIOD IMMEDIATELY PRECEDING YOUR NOTICE OF CLAIM. YOU HEREBY RELEASE RSMEANS AND ITS AFFILIATES FROM ANY AND ALL OBLIGATIONS, LIABILITIES AND CLAIMS IN EXCESS OF THIS LIMITATION. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

If You outsource the Software to a Hosting Services Provider for the sole purpose of enabling the Hosting Services Provider to provide to You operational and administrative functions (the “Services”) through Your server and client environment using the Software, which You outsource to Hosting Services Provider, the EULA is subject to the following additional terms (“Additional Terms”):
For each Single-User License that You purchase, You may Use one copy of the Software for a single named user at a single location. For each Site License that You purchase, You may Use the Software for each named user at a single location for which the Site License has been purchased. For each Network License that You purchase, You may Use the Software on a single network server or central computer which may serve only the number of named users (seat licenses) for which the Network License has been purchased.
For each Site License that You purchase, You may copy the Single-User version of the Software for each named user at a single location for which the Site License has been purchased. For each Network License that You purchase, You may Use the Software on a single network server or central computer (the “Server”) that utilizes a supported operating environment listed in the installation documentation and the Server may serve only the number of named users for each computer (seat licenses) for which the Network License has been purchased.
